Avoid revealing new employer on H1B

How do people on visa avoid revealing their next employer to their current employer? My manger is well aware of visa transfers etc. so I can’t just say still deciding, he’ll know I have everything approved when I resign. Also, are there any documents that I should collect before I resign that might make the green card process easier with my next employer? Edit: is there any reason to not reveal the new employer? Other than potentially being walked out immediately if it’s a competitor? #workvisa #h1b

Why and how did your manager come to know about your visa transfer? All you need is copy of 140. You could get experience letters but legal team of your employer might want them in different format.

You can say they haven’t filed yet. You plan to use the grace period of 60 days. It’s none of his business how you handle your immigration business.

People need to really stop using the word "transfer". There is really no such thing. You think your new employer will ping your current employer to "transfer" visa to them? Nope! All H1s are independent applications by an employer. Technically your new employer doesn't even need to your current employer.

Does new employer need old I-797 for the new petition? How does USCIS know when will old H1B becomes invalid/new H1B becomes effective?

The old/current petition is to show USCIS that you are already counted against the cap and you are in a valid H1 status now. Not to transfer anything. Validity dates are based on the dates requested by the new employer. Even if your current 797 is valid until 2024, your new 797 will be valid 3 years from the date requested(usually it’s the filed date) by new employer.
