Hi Guys, My previous company is giving this feedback in background verification "We decided to part way with X because of culture mismatch. We are sure he can thrive in a different environment and he is technically really good" What should i say to future employer if they ask " why i left previous firm"? Please help
Why did you really leave? Were you fired?
Yes
That is really unfair of your previous employer, imo.
Can you talk to your previous employer and try to smooth over so they don't give you shitty feedback?
Yes i ask them, he ask me to write a resignation from my personal email and CEO accepted thats all. Should i ask more? But I already found a job one company accepted this So should i worried again if some company do background check against all past companies?
That is horrible slandering feedback no one is going to hire you with that. It essentially says X was fired for cause. Take the company off your resume.
I spent there 10 months, it will show huge gap no?
In some states they can’t ask you about gaps, NY for sure, I bet CA too
Ideally they shouldn’t say anything beyond your dates of employment. You should have negotiated it before you parted ways. I would still encourage you to talk to them to keep it neutral. Usually employers don’t expect previous companies to disclose the reasons for termination.
Thanks but i am not sure what to write ? Can you please elaborate about keeping things neutral Or should i ask them to dont say anything related to culture
What do you mean by you’re not sure about what to write? Did they ask you to write the response?
They shouldn't have given that information. I believe they are only allowed, legally, to say that ...yes you worked there from x date to x date. That's bullshit.
I don't think that that's correct. If the statement was factual, it does not seem to fit the legal requirement to be classed as defamation. Many companies will choose not to say anything for liability reasons, but it's not inherently illegal for the OP's previous employer to say what they did if it's the truth. The matter is made more complicated due to specific state laws covering privileged speech. https://www.nolo.com/legal-encyclopedia/defamation-lawsuits-do-you-have-case-against-former-employer.html
Who are they giving the feedback to? They told you they're going to do this? Or do you see this on a background check report? Or the new HR told you? Or are you not differentiating between background check and referral? Have switched jobs like a thousand times now, haven't had this situation... So wondering if there's a misunderstanding somewhere...
I took contract position and its indirect contract from third party and so they did verification and shared with me before showing it to their client
Don't sweat about it too much... Reasonable people place some discount on a previous employer's opinions esp those that seem to hold a grudge like this. If the new client asks why you left provide an explanation that distinguishes them from your old employment without blaming the old employer outright.
Have you ever switched within 6 months for several times?
Bad decision always
Aren't background checks for only dates and titles? Never heard them actually trying to contact people unless a referral
WTF?!! First learn how to write a lucid sentence before asking for whatever it is you are asking 🤦♂️
What do you mean? Which part u didnt understand?
