CAP GAP for F1 student visa
Is there any limitations on numbers of month for the cap gap ? In case, if H1 B is picked in last chance of lottery but not approved immediately due to RFE and OPT extension expires say in June, how long the CAP GAP can extend? till the final decision (approved/rejected) H1 B?
I Believe you can continue on F1 status till you are waiting for decision on your petition. Will recommend to do web research for this.
ive read that if its not rejected and still pending (with rfe or otherwise) you can stay past oct 1 but you cannot keep working since the cap gap work authorization itself is only till sep 30 . So you gotta stop working and wait till you get the final result
File in premium so you get to know sooner and move on; if you’re not selected in lottery then it’s a different case altogether
As a rule you get CAP GAP extension till Oct 1 when the H1 status ticks in
