I have got my h1b approved this year and it got effective this month. I have got new job and want to change my employer is it good to work new employer it is Software Engineer 2 role. My new employer said they will upgrade for premium Processing if they accept in further. And they also said alternative if something happened wrong they will send to home and bring back with another petition.
I am in the same boat with a startup. They have been pretty slow in filing an LCA let along the h1. I don't have the confidence that they will work extra hard to get me if I am stuck due to h1 denial. I did not pursue the startup offer as I have lot of impending factors here. (family, assets, investments)
Well you can. Only risk is if h1b transfer get rejected in that case you might have to leave.

What you need to consider is if you really want to go through the hassle of moving out of the country and coming back in. Moving is a pain in the butt, even if the company puts it down on paper that will try everything they can to bring you back In. Negotiate with the new company. H1b application with background check etc.... generally takes about 6-8 weeks. That will push it to mid December. Now request to push the starting date to February and hope PP starts again
They already cleared my background verification.. and this week or early next week they’ll send my petition to USCIS
