We are on H1B with i140 approved for both husband and wife. Have a toddler too who was born in US and is a US citizen. We want our parents to live with us in US permanently as they are not keeping good health and need someone to care for them. Is there something in the Visa system that allows them to stay with us permanently (at least as long as we are in the US)? Going back and forth every 6 months is quite painful and does not seem worth the effort. #h1b #parents #visa
No. Our immigration system doesn't encourage burdens. They need to queue up and wait in their home country.
Not exactly true. Unlike Canada USA does allow that kind of burden to fall on the state. This is why we have so many folks who bring elderly here and make them the responsibility of the state, something the current government is trying to plug. Canada did this a long long time ago
Afaik a lot of parents just waited in line for years and finally came here at an age where they're more illness prone.
If it were allowed, every (most of em) immigrant’s parents would be living in the US. :-)
If you turn your GC to US citizen after 5 years you hold GC, you can file GC application for your parents, the process is less than a year.
^^ is this true? As a US citizen, if you sponsor your parents for GC, they get it in less than a year? Thought the family sponsored queue was longer than employment based.
There’s different queues for different family members. The one for adult siblings is pretty much worthless, immediate relatives (parents & children) is more or less just the filing if I remember correctly.

Free reign? I think you have broader problems to solve but I may be wrong. For your parents, I would suggest to have them visit you frequently, may be twice in year and you may visit twice an year. Getting resident Visa is hard. Ask your spouse, how lonely she will feel if she is in your parents shoes. Children learn from parents only and your kid soon learn the same. All assuming that you are from some asian country.
You need to be U.S.A. citizen to sponsor your parents. I know that for sure since I went thorough process. My Dad is going to work upon arrival though, since he is not even 60.
Short and is No. Long answer is you can get a medical related 'B' visa and make them stay. But that is extremely hard to prove that their treatment is not available anywhere else in the world and that you will be able to support their treatment here, without insurance.
