Being on h1b, has anyone opened an LLC.. any experiences, things to avoid and things to consider?
You only can work fir one company. So you can register a company, no problem. Cannot put yourself on the payroll.
You can't put yourself on payroll but you can work for your company.
Yes you can start an LLC. You cannot actively work for it neither be on the payroll. - with the exception that - if you decide to sponsor yourself through your own company [ In those cases you need a structure where you have a board of directors who have the ability to fire you - Essentially an employee-employer relationship] In case you just want an ownership interest in an LLC, USCIS has "guidelines' on what's considered active work. Work with your lawyer to see if you're stepping those boundaries. Also make sure your current job has no conflict of interest mentioned with what you're starting. As always, consult with a competent immigration lawyer. Source: I am a member of an LLC I started. I have a few friends who have done it as well.
Nobody will stop you but USCIS might potentially revoke your authorization during your next visa stamping or your h1b petition
I am a Canadian Citizen and on thr other side, I am thinking of coming on H4 EAD and open a corporation.
