Is "From the River to the Sea" So Wrong?
I have an offer from a company which is not headquartered in California but my offer is in California. They are requesting documentation around my current equity at my company. They want documentation with my name on it showing all details. Is this even legal?
Screen capture and be very good at photoshop.
Lol no ways
No chance this works. Its the obvious thing to do. Next they’ll ask for W-2 and they can go further.
Assuming your company has some web portal, access it and then just modify the html with the dev tools + print to pdf. Voila!
Even more illegal than what the prospective employer did. The prospective employer violated civil law. What you’re proposing is a (criminal) felony.
This! Modifying html will land you in jail in 53 states
Tell them to f-off. If they can't make a decision without anal probing, this will go on when you work there.
I think you're making this a bigger deal than you thought. At the end of the day, either they think you're worth something or not. Your current comp should not come into play. I would decline to share such info on the basis that's proprietary info of your current company. Imagine if a company goes around collecting detailed comp info of its competitors so that it can offer slightly better comp. We shouldn't give details of our comp and what stock management system our current employer uses to other companies. If the new company doesn't think you're with an offer because they think your current comp is lower, then this is a company that wants to pay you as little as it can not as much as you're worth. You'll be fine if they recind the offer.
That’s exactly how I think
Your first mistake was telling them anything. I am not sure how the law works but if you already volunteered how much your making then they just asking for verification. You can either fess up or just say you can't provide it.
It’s not legal to ask for compensation information. If the OP volunteered to provide it, it is still illegal for the company to ask for proof. The company violated the law. Google AB168.
I tried very hard to not provide any numbers on call. But the recruiter kept pushing and I gave in and just told him slightly elevated unvested equity.
Absolutely illegal. Just say “Under AB168 it is no longer legal to ask for current or historical compensation data in California. I’m surprised I was asked, and more surprised I’m being asked for proof. I’m excited to work there and look foreword to receiving the offer.”
It is at will employment, if they find out he’s dishonest regarding the info he told them, voluntarily, they can rescind the offer. Then, good luck fighting them in court, you have 1 lawyer? They have a dozen. OP, the advice 👆🏻is very cocky, and if the hiring manager gets this msg through the recruiter, there is a very good chance they’ll rescind their offer.
I understand. But I fear if I come strong this way, they might just say ok cool and later rescind the offer citing it didn't get higher up approvals or something. At this point, my aim is to have the job offer but not be low balled big time. Worst case, still have the job offer.
You have no obligation to answer this. Even if it is not legal to ask, companies break the law all the time. It's up to you if you want to answer.
Doesn't need to be legal. They want to verify you aren't a liar. Obviously you are a good person and negotiator so you didn't lie so just share? It can only benefit you.
If a company has to verify that you aren’t a liar then it shows a lack of trust up front. Pass
Why would anyone trust someone they don't know? Fb asked for proof and I shared. Glad they (like most) verify.
It’s legal for them to ask about invested equity and money you would leave on the table. It’s other parts of comp like base bonus etc that are a no no. Either way I would tell them to go f themselves unless you really want to work there. The only company I know that does that is google.
That is incorrect. Bonus and equity fall under benefits, which is illegal to ask about.
Lol it's not illegal
It’s not legal to ask for your current compensation. They sound sneaky and you gave them some imaginary number for your equity
I gave them a number which was a little higher than what it actually is as I didn't wanna get low balled. What should I do now? If I say no, they might rescind the offer. If I show them, it's gonna be a little lower than the number I gave them.
Recruiters are good at detecting lies in TC. You lied, what you can do now, is tell them the right number :) I highly doubt it was a little higher, it must be LOT higher than what the actual number is. Otherwise, they wouldn’t have asked for it. If you fake it like the post below suggests, it is considered forgery, which is a punishable crime. So, do the right thing and don’t lie
