Hi, I have a quick question. I worked in a marketing role at Medtronic and was recently laid off. I see a position at a competitor’s website that I want to apply to but I’m worried about the no compete. It is a marketing role in a totally different state. Also not the same product( but probably same family - TAVR) My mentor who is a VP in a cross functional team said I shouldn’t worry about it and still go ahead and interview for the role. It doesn’t apply in California and few other states. Check your agreement.

I got laid off too and lawyer confirmed non competes cannot be enforced in California

Just lie and say you don't have one and don't update your LinkedIn until after the period is up. These agreements aren't worth the paper they are written on but they can spook the other company during the interview process.
