I got a DUI while visiting Canada. I hold a H1B visa and I-140 with the new company yet to be filed (hold a approved I-140 from previous employer). Need to know from your experience how DUI received from Canada might impact my Visa/Immigration status in US and how this will impact my Green card application and final status in future. Do employer take adverse action upon first DUI? Do I need to inform my employer/immigration team. I am already stressed out, so requesting not to troll rather share experience if anyone have any? Any good immigration attorney recommendation will be highly appreciated. Thanks in advance! TC: 300k
Don't expect much sympathy. DUIs are a very scummy crime. Many folks know someone killed by a drunk driver
I’m not a lawyer. But here’s my take. You should be fine for your H1b extensions and stamping interviews. Your chances of getting a US/Canada PR is basically screwed. Best bet is to hire a lawyer and spend a ton of money in getting your DUI contested and lowering it to a minor infraction.
if you can't do the time, don't do the crime
Wait at least 5 years since your DUI to apply for your green card. You need to be of good moral character for at least 5 years and the DUI is a disqualifying crime.
It's 7 years, not 5. That is how far back background checks are typically used, but not unheard of to see them go as far back as 10.
In some states DUIs stay on record for 10 years. You will need to disclose this on your citizenship application regardless of how long you wait.
I don’t know about the Canada part but if this happened in the US, you would need to get a lawyer and contest it to reduce the impact
I am almost certain that any DUI in Canada will follow you home in America.
Consult a immigration lawyer!
Lawyer time.
Get a lawyer!! My friend was in a similar situation and she got a lawyer who helped her
Did your friend got DUI in Canada while on tourist visa?
OP, it's not the end of the world but your immigration just got a lot harder. Do it again and you might as well pack your bags. No idea how the Canadian system works so best consult a lawyer.
You should have thought of this before drinking and driving. This is the part where you face the consequences.
