I have been diagnosed with cancer stage 3 and not sure what to do next. My treatment started and working on and off. Sometime I feel better and other time I have side effects and pain. I'm on h1b visa and I have used my all short term disability. My greencard application is still pending status and my priority date is current. I have combo card approved so there is some relief. If I go for long term disability and get separation letter from employer, will it affect my greencard approval? HR hinted me that they won't be able to keep me long as I have not worked for 6 month now. And they suggested to get separation letter if i need more leave. I don't want to intrupt my current treatment as I have big hope from treatment to get heal. Not sure if I can get same treatment back in my country. Sometime I feel I have limited time and I should leave everything and go back home. But only things holding me back here is my treatment which I have to take every 2 weeks. Also I don't know if my kids will be adjusted to a new country as they are very young. My current manager and HR are very supportives. Any suggestions will help me. TIA. I suspect you won’t be able to continue your employer’s health insurance if you get separation letter.
It's complicated. I will be on cobra and insurance stays same. Hr said employer will pay for 1 year then I have to pay for the health insurance. I think it will be very expensive. But good thing is I get to keep the same insurance.
You are on EAD GC its as good as gc on terms of benifts. Contact a good attorney and try to get all benefits which US has to offer like disability eyc
Thanks. Yes I feel ead is good enough. But in case my i485 got rejected for any reason like I'm not with the employer or something. I am not sure if I can renew EAD card. It comes with 2 year validity. And I have to renew AP every year.
From treatment perspective US has the best medical support system for complex diseases like Cancer. However it comes at a cost as we don’t have it for free and employer has to support. Kind of counter intuitive as employer can only go up to a point as it is a capitalist country. You should consult an immigration lawyer. My understanding is you absolutely need an employer to support you on EAD/AP. Separation letter may not work as you will be out of status. Also, medical insurance will be needed and new employer may not support from Day 1. So my suggestion is try to do at least part time or somehow get on payroll to continue receiving your medical benefits and being in status. Hope you find strength in these difficult times. Hang in there you will get better soon.

Yes I am trying hard to go back to work for insurance and visa. Hope I survive at work with tasks and don't damage my health while working.

Yes I agree with you. I didn't knew Farid Fata before. Also I saw some news about other big medical insurance scams. I really get worried. Healthcare is a big mess. But I am not in position to fight with them. I hope my treatment ends soon though .
