I have seen lot of posts saying Indians are abusing the H-1B. First to clarify, Indians are not abusing the system. Some companies from India are abusing the system. So let’s start with stopping to generalize a whole nation. Next, S386 is not the right solution which many Indians that are in US based on skills agree with as well. They are not opposing it. Third, deciding EB based GC based on country of birth is not correct. Pace of birth is something no one has control over. So there needs to be a better attribute than country of birth. Some folks complaining about diversity. Yes, diversity is important but many came to US for better lives. So rather than choosing by country of birth (again soeaking for EB visas) pick some other attribute. And if you still complain about diversity, then lets stop giving GCs to Germans, French, and folks from Iran, Italy and give it to those countries where there arent many people from. What happened to diversity from 2015 census. Maintain equal diversity in population from all countries. as you can see, we have enough Germans, Mexicans, Irish. English. Fair! That should be stopped. So grant visas and GC to those that have skills and stop chain based immigration for everyone. Make it immediate family like SO, parents or children. Siblings could be stopped as well. Then again, the point of this post is to have an educated arguments and rather not play a blame game.

My point of view on this immigration is as much of an emotional issue as it is a logical issue. Perhaps even more so. While I see the validity of your argument, you need to recognize that the intent of the people who created the per country caps was to protect European immigration to the US. ‘Diversity’ is just a side effect. (Sadly,) You won’t change many minds with this argument. On a broader note, Indians in the green card backlog feel aggrieved by the fact that they are denied a path to residency in America because of an immutable attribute. This is perfectly understandable. However, what will give us power in this relationship with America is to recognize that while we may not be able to change America’s laws, we can control our own circumstances. There are many many amazing countries out there which are inviting, even enticing highly skilled engineers to move there. Vote with your feet and leave this abusive relationship with America.

Again, Indians in US do not have any say in many propositions. Many don’t complain either. Even S386 was pushed by some genuine people but many such people that came through abuse. I’ll not go into debate for that. But if it helps, petitions were created talking about such abuse. But those petitions were not considered. I am trying to give an educated analysis that considering country of birth for employment based GCs is not the correct way. Maybe put attributes like higher base pay, points based on educational a skills, and other attributes along with the specialized occupation and make it stricter. But a merit based residency has been an argument for too long that no politician is actually considering. Hope that gave explanation to at least part of your question.
