Do I need to pack back my sign-on bonus?

Hi guys, I recently got an offer and decide to accept it. Now I have some concern about the sign-on bonus paying back. I joined Walmart two years ago. Then I visited my family last year and tried to get the visa. But due to covid-19, I could not return to US until April this year. Also, I started unpaid leave in July last year which is before the first year anniversary of my employment. I recovered from that after I returned to US. Due to the statement of offer letter, I need to refund the sign-on bonus if I decide to terminate the hire relationship within a year or if I fail to return from a non-job protected leave of absence which is the time when I unpaid leave. I am wondering if I actually need to repay that bonus on my last day of employment? To be clear: Hire time: ~2 yrs Paid time (exclude time when I am unpaid leave): 15 months Time in US while I am in Walmart: 8 months. I was working remotely after pandemic, but then they asked me to unpaid leave. Any thoughts or ideas? curr tc: 190k future tc: 280k #walmart #walmartbonus #misc Update: - started unpaid leave last year not this year.

Are you talking about a sign-on bonus that you received when you joined Walmart 2 years ago? Why would you need to repay that? Also, how can you be hitting your first year anniversary this year if you joined Walmart 2 years ago? Your description of the situation is unclear. Regardless, I would find it unusual to see a clause in a contract that requires sign-on bonus to be repaid beyond one year. Edit : understand your unpaid leave started last year. If you have actually worked for them for 15 months (excluding your unpaid leave), you have no reason to repay anything so long as your contract only required you to work for a minimum of one year. Would confirm with HR but don't ask them tell them - based on your contract, you have worked for them for more than a year (2+ if you count the unpaid leave portion) and you are giving notice. I have learnt not to ask questions where it leaves the other party room to come back with an answer that's not favorable to you.

Sorry for the confusion. I started my unpaid leave last year which is before my first year employment and that means during my first year in Walmart, I had about 5 months in unpaid LOA. I wanna get some thoughts about this situation since in the contract, it said if you do not recover from LOA within your first year, you need to repay it.

Got it, thanks! Yes, I also agree that not asking their question but just confirm with them if my understanding is correct or not.

Sit back and wait for then to ask you to pay. If they don’t ask, don’t bother to ask yourself and pay.

Ive only gotten one sign on bonus and it was fully vested in 1 yr. So u shouldnt be on the hook to payback any u less u had some strange sign on structure. But, yes any time u leave within a year, youd be on the hook to repay. Anything separation past a year u dont owe. Read the details in offer letter and like many ppl said here check with HR

Sometimes sign-on bonus is structured over 2 years. Depends on level I think . I was 75 and had 2 year sign-on bonus.
