Do you hate PIP? Then fix the GC backlog.

Amazon, Meta, Stripe, etc. will afford to continue with the PIP process because Visa workers, with no mobility options, are forced to stay at one company. They continue to slog at these companies until they get a GC or are laid off. They cannot afford to get some time off in order to prepare and join somewhere else. This intensity is multiplied for immigrant parents with kids. As a result, the only option is to work, year over year, to avoid pip. Entire teams, manager, skip manager, director, etc. all on H1B and work extra hard. Those who dont fit in get PIPed. A tech company's core businesses are never affected due to loyal visa workers. All because the 60 day window is too tight to risk slacking and interviewing. I know many citizens and GC holders who dont tolerat the BS of PIP. They have the guts to simply say no and move on to another job. Hence, the tech industry must lobby to fix the immigration issues if it desires to get rid of the PIP toxicity. The benefits to companies from indentured workers far outweigh the cost of their disgruntlement. As long as there is a line of people willing to take the current immigration deal, nothing is going to change.

One thing you need to understand is that corporations will always look for a way to make a profit. When you close one door, they will find another, where your interests will be completely irrelevant. If you make H1B process not to work in their favor, they will move to opening offices in other countries where the laws and cost of labor benefit them. And people would not even have a chance to come on H1B.

It's time for tech to Unionize in some fashion. The now is way different than the past. None of these were problems in the past: Making mobility harder Working long hours Switching company is taking up another Leetcoding job thats not relevant either and what kind of career has interviews where odds of getting a job are so random. Not letting employees benefit from IPOs with shitty clauses. Work can easily be 80+ hours with oncall etc Layoffs for no reason are a trend now. No more Perks Actually PIP is the new perk. People from everywhere have entered and destroyed the industry. DI is heavily abused and so are roles like PM, TPM

How unionization will help to solve your last point? In fact, it will make mediocre people and freeloaders thrive because of the union protection. This will be the end of innovation. Btw, I agree with many of your other points but just do not see how bureaucracy can fix it. In fact, it will make them only worse. I would only regulate oncall hours. Everything else is hard to measure and address.

This is SO wrong. H1B is Dual intent visa, in the past if you don’t GC within 6 years of H1B expiry you have to leave, FAIR. Well, due to backlog even people who filed for GC in 4th year of H1B would max out, so congress put a bandaid fix by allowing unlimited H1B renewal for people who are approved for GC aka i140 but waiting on visa numbers to adjust status to permanent resident aka i485. While you may consider this as H1B and temporary, most H1Bs are already approved for GC but not permanent resident because of backlog and hence they remain on H1B till then. If you don’t understand the laws don’t speak out of your ass please, get educated first.

I am not a white American and I came here on H1B. I do not think working visa program is unreasonable. What is exactly draconian about it? It’s not like we are selling our souls to satan. Yes, companies lock ppl in for several years but they also need some return in investment. That’s understandable. What would you suggest as a better process that helps both sides?
