I have my I-140 approved with Salesforce. I'm considering switching companies (TC dropped significantly this year with cliff) - what's the risk associated with the move given my GC timelines? I'm EB2 with a Sep 2015 priority date. If I switch now, how long (best case, assuming they start the process right away) will the new company be in a position to file my GC if it becomes current? What is the process - the new company will have to do an I140 + perm labor? #workvisa #h1b #greencard
I would advise staying in your current position until you get the GC. I switched jobs last year with the expectation of getting GC thru EB3. However that category retrogressed.. and now I am refiling PERM with my new employer even though my EB2 dates are current.
What happens if you don't file i485 within a year ? Do you abandon the whole green card and priority dates ? That's scary
You’ll know by second week of September(October dates get announced) whether the dates for next year progress to September 2015 for Eb2.
Planning to wait until at least then. But if the dates stay put or fall back, do I keep waiting or switch? I'm hoping someone can provide insight into how long the process will take to get to the same level at a new company where I'm ready to file again. And/or can i140 and GC be filed concurrently.
PWD is taking 6-8 months now + 2-3 months job ads + 6 months perm + 1 month 140 To this you have to add time taken by the law firm in between each step to prepare the paperwork.
Just leave. You will get green card eventually.
I would recommend to stay. Based on some stats we may get 50k to 80k visas from family to employment category. so there could be chance for you! Another 2 months not so long !
Don’t switch. PERM process has been taking up to 2 years. You don’t want to go to new place and file a new perm. At least wait for next 2-3 bulletins.
Next bulletin you will see a retrogression likely.
