I filed last year in July. My project was the PTC highway project and waiting for my i-526 approval. I wanted to reach out and see if anyone is waiting too or has just received their approval. I am from India, but please comment regardless of country. I am trying to figure out how the new law in March has changed the rate of processing speed for each country. If you did can you mention your priority date, country and approval dates that would be great. Also if anyone has any questions, I would be happy to help. Thank you
I am also considering eb5 route. But is concerned about loss of investment. How did you go about picking the project? What is your expectation? Do you expect to lose some portion of your investment. Or do you expect it to increase. Also, how much it costed in attorney and other fees?
How long does it actually take? I was checking the DVRC site and it says it will take about 7-10 years just for USCIS processing. Add lawyer time, that's more than 10 years!
Yep
It takes some time for you to become a GC permanently and a time for you to be off H1b. The permanent GC takes 7-10 years but being off h1b the conditional GC takes about a couple of years.
Applied Mar 2018. I526 approved in Apr 2020.
Congratulations, I am happy for you. Which country are you from?
India. If not, I would have got GC via EB2 longtime back.
Applied in June 2018 and still waiting
We filed for our I-526 in November 2018, it got approved in September 2019, and we got our conditional GC about a month ago. So it took about 20 months in total from filing the I-526 to getting our GC. We plan to file for citizenship in 5 years so we can get it as soon as the permanent GC is approved, which will take another 2+3 to 4 years based on current processing times.
What is approximate wait time to get the non conditional GC if one were to apply today. I recently read the priority date for Eb5 Indians became current but not sure how that translates to new applicants. https://www.eb5daily.com/2020/07/july-2020-no-more-visa-backlog-for-indian-eb-5-investors/
Expect 6-9 years. Dates are current only because uscis is slow to process i526. There are thousands of people in queue. Eb5 India gets only 700 total gc per year including family members
It depends on USCIS processing times for the different applications in the process. Itβs currently taking anywhere between 1-4 years to get your I-526 approved so you should get your conditional GC in 1.5-5 years. After that you can apply for removal of conditions in 2 years, and that is taking about 3-4 years right now so youβre looking at anywhere between 4.5-9 years for the permanent GC and to get your capital back, assuming the priority date stays current. That said, conditional GC is no different than the permanent GC in terms of its benefits so youβre a permanent resident the day your conditional GC/I-485 is approved. Permanent GC can take its own time but your money is stuck until the permanent GC is approved.
Thanks for explaining. I was wondering why the long wait times while the priority date is current. Separately, if I were to go with a direct investment how long would I need to keep the investment/business going? Until I get the i-526 or until get the permanent GC?
I also have same question.
