Ex-employer bullying

Looking for some thoughts 💭 on how to go about an ex-employer situation. Few major points For simplicity sake let’s call my ex-employer Company A - which is staffing agency who was my w2 employer. Not like Deloitte or Accenture where you have a manager in consulting -client relationship type roles. This company sourced me, simply ran my paycheck. - I worked through an company A and was placed in one of the FAANG and worked for about 6 months only - Now I am at much much senior role in my new job in a small company. Was able to secure this role thru some serious networking. While quite hectic some days I value my current employer. Enjoy the autonomy and like what I do. Been in this role over 6 months now. - Company A first threatened me via email and phone, I didn’t budge and has come with a legal letter where they are asking me to remove FAANG company name from my linkedin and threatening saying I broke confidentiality agreement. I haven’t. publicly thru linkedin or to my new employer
..shared any project details except “client” name and team name which in my opinion is general info and my lawyer’s opinion by law also very general and not confidential. I got legal opinion further and my lawyer reviewed my contracts, I have been advised that under California law this company As ask is way over broad and legally they cannot restrict me to use “client” name in my experience. I am no where calling the “client” my employer. Company A - is saying by using the Client name in experience section in this case on linkedin and using their name it creates a perception in viewers mind that I was directly employed by the client, FAANG in this case. None of my contracts say I can’t use client name. My lawyer has made pretty solid arguments so far. Wanting to know if anyone has delt with this kind of situation before? I don’t understand why does my ex-w2 employer care so much about what I put on LinkedIn. I have 10yrs of deep work ex in a fintech domain TC250k #tech

Here are my 2 cents, if you want to overcome the headache just suspend your LinkedIn account for a couple of months until they forget about you and reactivate after with FAANG as an employer.

I would recommend making your linkedin only visible to linkedin users vs everyone (unless you need it for recruiting) and block your ex employer from seeing it. But If your lawyer says you're good, then you're good. It would cost them more money to go after you for it in court and they likely won't win as they need to be able to show proof that your naming the company is causing damage to their business, so I dont think there's anything they can legally do to make you take down the company name from your linkedin profile

I don't understand why they care either. I can't possibly believe they would spend actual $$$ on what would at the very least be an expensive and in all likelihood unsuccessful case against you. Sending you a letter, sure. Actually going through a legal case? Tell them to pound sand. Or better yet don't tell them anything.

It’s unbelievable to me. Hard to understand any logical motivation behind it. But will provide and update on this post. Thanks for your input.

Send letter from your lawyer mentioning ex employer is harassing and causing you stress. One letter should stop this non sense.

Honestly, working as a contractor at FAANG through proxy company and then adding FAANG to your LI profile is cringe.

Microsoft Hotdog1234 Apr 1, 2023

Have you seen LinkedIn? It's full of way cringier things. It's also not a legal matter

Amazon \0 Apr 1, 2023

Sure, it adds to the overall cringe of LinkedIn.

Usually people put something like “Microsoft (contract via Contractorama)” Legally, there are some distinctions that need to be made between fte and contingent employees. Maybe that’s why they’re making a big deal about this?

Perhaps. Will keep this post updated. Thank you for your input.
