My current company has filed my green card in EB2 category a while back and have my priority date going back in 2013. Given current wait list for Indians, I don't I expect my green card to come in this lifetime. I was just wondering if I were to leave my current company and join another Tech company say Google/Facebook/Apple. Will they do my Green card in EB1? Thanks
That's what I am trying to understand
Do you’ve some excellence in some specialized area(phd/post doc) or international manager experience? If not then no company can file EB1 for you.
EB1 is hard to get. Talk to your immigration lawyer about your qualifications
Two easier alternatives - go back to India and come back as manager. Go to Canada come back on T1N.
TN is not dual intent, so you can’t use it to apply for green card.
Yes, but you can stay on T1N. You won’t need GC.
For TN Visa, I need to be Canadian citizen?
Yes
When my current company applied, they considered my current US experience and that included my US experience (3years) + foreign experience (3) at that time
Won't the new company consider all US experience ?
If you actually do research and have been published, EB1 is realistic. There are a few EB1s, the research based one and the ability one are merit based and hard to get. Like someone else suggested, go to India and come back as a multinational manager if you want a shot.
EB1 is going to be backlogged badly in a few years.
For EB GCs all your experience incl US is considered, except the experience in the company that's filing the GC for you.
Doesn’t the experience have to be prior to entry into the US?
