The applicant never files - ultimately the employer is responsible for all representations made. Unless the resume, transcripts etc. are fake - which are supporting documents and not involved in filing. I am seeing the case tipping in favor of the plaintiffs.
Consultancies will have them filed through a few sister consultancies as well. They work in a network. Visa mafias.
Ok, so the gist is these companies that DHS authorized with e-verify to hire graduates with OPT are actually scams because they tell you that you’ll be a contractor working for top companies (like Adecco) but once they hire you, they make you pay for training and never put you in any company so you make no money. DHS is seeing this as people paying to stay under OPT but if they didn’t know they got scammed. The people in the lawsuit are those that left the scam companies for real companies and once these companies applied for HB1 and they got selected, DHS told them they can have the visa because they were hired by the scammed companies.
What’s the point of eVerify if they can’t verify employers integrity.

Scammers gonna scam. And this actually seems like a scam that would be pretty easy to perpetrate on competent people, sadly… so this does seem doubly unfair 😔
I am certain that these students absolutely knew what they were getting into, as much as I hate these consultancies, they are pretty clear how they operate and are forthright with it, they talk about faking resume, paying for your own h1b, etc etc. Nevertheless, I still hope that these consultancies are investigated and their whole modus operandi is out in the public.
I am certain than universities and USCIS scammed these students that America is a great land of opportunity, you will find a good job after graduation and you won’t be discriminated because of your birth country. Nevertheless I hope the incoming students see how American dream is sold as a scam to them for thousand of dollars of useless fees. Drs who fix symptoms are charlatans to make their own money. Leaders who fix root cause problems do not blame others for their own problems.
@Adobe America is a great land of opportunity for those who work hard and don’t look for shortcuts. From the beginning itself, these folks get their SOPs and letter of recommendation from agencies in Hyderabad to get the admission in any universities they can and then party during their entire program period and final semester look for these fraud consultancies to get the contract jobs to get their H1B filed by multiple companies. Few telugu folks were bluntly telling me about this process. They already know what they are getting into.
How, exactly, is it the US government's fault that the company they aligned with was the culprit? The company didn't do the right thing, sue them, not the US government.

The US government has every right to deny a visa. If the business is a private entity, they government has to prove criminal behavior first, it can't simply shut the business down. The DOJ has to get involved, courts, etc.
