Provided your company initiate GC the day you land, it will take anywhere between 12-15 months to get your I140 approved. All the best.
But there is premium processing in i140 through eb2 right ? Wouldn't that drastically cut the time?
The above mentioned timeline is with premium processing of I140. Without premium processing it can go up to 18-20 months.
Would it not be an option to have the company file for GC for the wife also right away? I heard that an EAD would be issued even when the GC app is pending. That would be after about 3 months. I was told that could be an option for us. Google / O1
You land in USA on day 1. Work with management to agree to initiate GC process - 3 months to 5 yrs. Management approves GC.. asks legal to get involved. -1 month to 6 months. Legal asks manager for job skills requirements, asks you bunch of docs, asks for experience letters from past employer in specific format proving you have the required skills for the job before you joined current job. - 6 months Legal files labor condition application with DOL (aka prevailing wage determination ) - approval takes 3 to 9 months. Legal puts advertisement in newspaper for you job and waits for American candidates - govt mandated 2 months Legal and manager interviews candidates - 1 month. Legal prepares PERM application - 1 month DOL approves PERM - 4 to 8 months Legal files i140 - if premium 15 days.. else 4 months. You file EAD. - 4 months ( can be premium if filed along with H1B extension)
You differentiate between PERM and Labor condition. Are they different? What is LC which takes 3 to 9 months?
What if they find a really great local American talent during this “interview” phase?
