HELP please !!!! visa question

a person worked in company A where their i140 was approved and worked on h1. they are already on h1 for more than 6 years. that person now works for company B with a h1 transfer but haven’t filed for i140 yet. now that person has an offer from company C and company A has withdrawn i140 but their priority date is locked because they left A much after 18 month mark since i140 was approved. what should that person do??!!! should they wait in compnay B until i140 is filed and then wait for 18 months so the date is not lost or just move to C and their priority date will still be fine? feel so helpless!!! waiting for gc forever and dont want to miss out on opportunity with company C.

For such matters you should always consult an immigration attorney. You should contact Murthy firm for a 30 mins call, they charge around $200 (trust me it is worth it) and $300 if you want to get advice from Sheela Murthy herself. Good luck!!

Go ahead and join the C company. I was in a similar position. Once 140 is approved ( not just filed) and 6 months old, your priority date is locked. Also, talk to an attorney if needed.. just to be sure. If your 140 is not approved, then that can be an issue

Dude I don’t know where you are getting this rule about 180days since I140 is filed. It’s 180 days since I140 is approved. You should talk to the attorneys of company C. They can tell you what they can do. Whatever they tell you, make sure to cross check against the USCIS website about the rules they are talking about, just to be sure. And of course don’t tel company B until you get the h1b approved. In case the attorney tells you to stay put at company B, and the company C is one of the bigger companies, they can wait till your I140 situation resolves (maybe).

As far as I know a company cannot withdraw I 140 if I-140 is approved and the employee with them for 180 days ... which means you can still get h1b extensions transfers with that approved I 140 if yours approved after 2016 https://www.employmentlawworldview.com/immigration-changes-in-2017-new-high-skilled-worker-rule-provides-mobility-for-employees-and-predictability-to-employers/

It was approved in 2016 and I stayed there for more than 180 days after it was approved.

You should be able to switch companies, just make sure you have ur perm and i140 done by the time ur PD is current.
