Last month I was among the many that got the dreaded lay off email from Beth To add salt to my wounds, apparently my manager decided to put me in focus without telling and I found out during the meeting with the skip and HR that I need VP approval to switch teams. I had previously told my boss that I will more than likely be deployed this year as part of my service with the national guard so I suspect (can't confirm) that this is why I got the axe. Not willing to go down without a fight, I contacted my JAG and told them about this and they helped me draft a USERRA violation letter and I also contacted the ESGR about this. For those that don't know, employers are not allowed to discriminate against service members and those laws basically are designed to protect us from bad actors. I promptly emailed my boss,skip and HR the letter (cc'ing the lawyers) telling them of their infractions. 3 days later I got a meeting request to discuss which I promptly declined and asked that they send any correspondence in email(again cc'ing lawyers). They replied and said that they are revoking my layoff and reinstating me but did not mention the bogus focus so I assumed it still stood. I replied and stated that I am deploying effective March 12th and will be back in 11 months and also stated that due to the stress of the layoff I need some time to ramp up again and they agreed that I can "take it easy and won't have any deliverables between now and my deployment" Now Amazon has to pay my salary and RSUs while I'm on my deployment. Moral of the story is that sometimes the little guy wins I am reposting here in the general section so that any other service members can also use this to fight back the layoff EDIT: some things I want to clarify as a lot of folks are messaging me. 1. For absences of longer than 180 days, you are allowed to take 90 days off to re-adjust to civilian life so I am not milking anything 2. I was completely honest with Amazon about being in the military and in fact they were "proud to hire me" and asked me to sign documents allowing them to use me in promotional materials etc. 3. I have not signed any NDA or anything that says that I can't talk about my situation and I think it's silly to keep it to myself and not let other people learn from my experience 4. I would have liked to stay at Amazon but unfortunately they apparently don't want me since they decided to put me on focus and lay me off at the same time. We will see what happens when I return, I am guessing they will probably try to manage me out 5. Companies don't pay employees salary during deployment. Amazon has a benefit where they will match your previous salary on deployment for up to 1 year. They do this for publicity with the knowledge that very few tech employees will be using this benefit #severance #layoff TC 236
