So at this point everyone knows the problem with hr1044 is that the India queue contains a very large number of low quality applications submitted by Cognizant, Wipro, Infosys, etc, and that high quality applicants from r.o.w. would end up waiting years while these low quality applicants are processed. There's a relatively straight forward fix: 1. Add a base salary criteria to EB2 queue, and adjust it up and down until there is no backlog. Any applicants who don't qualify move to EB3. 2. Reallocate 25k visas from EB3 to EB2 so the it's 65k/15k instead of 40k/40k 3. Remove the country cap for EB2 The effect of this is we would clear the India backlog in order of salary. The first year the salary cap might be very high, and every year we'd get greencards to the next 65k most meritorious candidates. There would never be an EB2 backog because the threshold would adjust to prevent it. With the skilled EB2 queue the goal is to get people in order by merit so removing the cap and priorizing the more meritorious people makes sense. For the unskilled EB3 queue merit is not a consideration by definition so it makes sense to prioritize on a non merit basis there, perhaps diversity. Maybe a lottery can be used in eb3 instead of a waiting queue. This would actually get greencards to the best people from India FASTER than hr1044 since there would be 65k visas available. The country cap should also be removed from EB1 for the same reason, but in that case perhaps try an find a way to prioritize by influence rather than salary (number and degree of publications and commendations). Or maybe just remove it for now if it's too hard to create ranking.
Salary should not be the only criteria. People in the software industry generally would get paid much more than someone from say manufacturing side. It wouldn't be fair to them. A better way would Just be to overhaul the entire thing and replace it by a point merit based system in my opinion

Why would employers sponser green cards if they want to pay dirt cheap.
They wouldn't. That's the point. Then there would be more greencards available for other employers who want to hire highly skilled people. Fewer cognizant petitions and more Intel ones.
Why not sort by cumulative taxes paid to the us government. The longer you are in the queue the more taxes you have paid the more you “deserve” to get a Green card. Again sort by this but you can also have a cutoff like eb5 . Let’s say when you get to 500k(inflation adjusted) of total tax paid you automatically qualify.

Add country quotas for h1bs and opts would be the best solution so system becomes balanced. Otherwise its obvious bottleneck. Opts are unlimited while ebs are limited.
