Hey friends, I found a hack for H-1B visa holders with US jobs to always be with their parents. This is how we do it: 1. Get B1/B2 visa for parents. 2. Have them stay with you from March to September (6months) in US when the weather is good. 3. Beginning fall, travel to India with parents. 4. Stay the fall, winter mild weather in India with parents, and work from India for 6 months. You can stay up to 180 days without paying India taxes. 5. Return with parents to US in March. Do you think this holds legally? What do you think of this approach?

A lot of firms don't allow work from another country. Plus how long can parents keep up with the travel :( how about health insurance and being covered for every illness?
I think Microsoft does, one colleague worked for a few months in India. Health insurance will need to be looked into... Hmm travel is it too bad every 6 months?
Op, I have a single mom in india and been looking for solutions too. Health insurance doesn't cover pre determined illnesses etc. If Microsoft does it ll be a one off thing. It cannot be every year given tax implications. Then they might as well pay you the india salary and everyone would have worked from india 6 months. Think of a 24 hour flight for parents as they grow older, say 70+. It is terribly hard on them. Plus independence.and all that here for them. That is a secondary issue of course
#4 is not valid. You avoid india taxes yes but since your payroll taxes are paid in US there is a different violation coming your way.

There are tax implications, companies can only have so many expat employees. And not everyone qualifies for being an expat employee. I am no expat but unless there are extenuating you wonโt be able to get more than 2 months work from india on us payroll.
Doesn't this plan fall apart if you are married or have kids of your own? Plus very few companies allow you to be on the US payroll and work remotely from India for 6 months every year.

Married so what? Spouse will also be part of it. Kids yes that is a problem... I think Microsoft will allow, why would it care that I am working from India every year if manager is ok to have remote employee.
Why B1 visa.. visitor visa is enough right? 6 month stay is a lot every year. Company will allow occasionally but not every year
B1/B2 is a combined category and includes Visitor visa ๐คฆโโ๏ธ

How would it work? Move to Canada as a PR or do 6 months in Canada instead of India?
