Just throwing this topic out there 1. Do you guys think L-1 visa employees aren't as fairly treated as their H-1B counterparts and GC/Citizens counterparts. The fact that they can't switch companies is a hurdle for them when it comes to negotiating their salaries, promotions, etc 2. How is your company treating L-1 visa holders? Are they low balled when they first come to the US? Do they get promoted as easily as others? Do they get raises regularly? 3. If L-1 visa holders are treated badly, why would people still accept coming to US on such visa? Why would they put themselves in a position where they're the most vulnerable? 4. Can we go as far as considering L-1 as a mean to enslave people (without letting them know)? Ps: I've got a lot of L-1 visa holders friends and all I hear is complaining about their miserable conditions and how badly they've been treated
Its a free market and I am sure that no one forced anyone to move to US on a visa. It is a risk versus rewards decision... I moved to the US on a visa because of the opportunities it afforded me and my family. We are greatly fulfilled by our life here and felt that the constraints of the visa were a fair cost for what we got out of the move... Just saying that a lot people start complaining about such things without really thinking about their role in the chronology of events that led them to their current state of being. It would have been "enslaving" if they had little say in the direction of their lives but that is not true. For the specific concerns of discrimination - at least for my friends across Amazon, Google, and Microsoft - I have not heard of any discriminatory treatment against L1 visa holders.
Well by not having a choice to change job, can't we say that's a way of "enslaving" them. Based on your definition of slavery "they had little say in the direction of their lives" and considering work as a major component of someone's life and knowing that they "have NO say on their work decision", wouldn't that be qualified as slavery ? I am just using your own definition here
Well they knew of that limitation of the visa, didn't they? They could have chosen to not move until they got an H1b if that was an unacceptable arrangement. So they had the choice and they made one - they chose to move to US over the flexibility to change jobs.
It's a tricky situation. People outside US while applying for a US position do not generally realize the implications while being on certain visa type. It's mostly like "I'll figure something out" It's entirely different story when they get actually here.
L1 visa holder can not change employer. A good employer like Microsoft will pay competitive package. I know many L1 coworkers who are paid well. But then there are other employers who will take advantage of this situation.
It's kind of bonded labor in that situation (not strictly in legal terms as you can leave the country any time) but it does puts you in a bad situation since you may be invested in your current role, location, moved family bought home etc.

You are comparing two extremes. The immigration system ensures that a person on a visa is not paid less than an American who could have done that job if we had enough Americans. So what you are talking about - comparing that to exploiting poor people is an invalid argument. If managers exploit you - you have legal protections against that too. So the legal system while not perfect or ideal - does provide a structure for individual protection against discrimination. Are you saying that people on visa will not do anything to protect their rights and the system is to blame for it?
I was in an L1b, and was 100% happy. MS treated me great, good promo. I'd say it had zero impact on my career. No different now I have GC. All depends on the employer!
I am curious how long it took you to get a green card. I am in 8th year and still waiting....

If you from India or China, and you want a better life or opportunities elsewhere, better option is to immigrate to Canada or Australia. Work visa in the US is in the state of mess right now. It's not going to be solved any time sooner.

Earlier L1 spouses were allowed to work but not H1bs spouses. Do you know how painfull it was to go through for me and my spouse. Everyone has some adv and some dis-adv. suck it up

Why earlier? Even now, h4s cant work until h1b gets an i140 , that takes at least a year. Also who knows how long h4ead is gonna stay. Another disadvantage-many h1b aspirants spend years studying here but still cant get an h1b in the stupid lottery after multiple tries and have to move out. Think about their pain!
Why can’t you get a new job and apply for H1? Once it is approved you can join. Hell you can have a consultant file for you while on L1 and then use that H1 to transfer to the company you want to join
L1 doesn't require LCA.. I've heard of L1 people getting paid less in general across different companies compared to US citizens or H1B holders who need LCA.
Here we go, that's what I am talking about and that's where I think it is unfair and unjust cuz you're being descriminated against based on your immigration status
If some one is on L1, they should push to have H1B filed by the company.. again each has their own problems and situations, like spouse using L1B to work etc.. H1B gives you a better chance at getting market salary than L1. Plus on H1 you can leave, so there is onus on employer to keep you salary happy!
