Layoff during visa stamping

What happens if someone is traveling for Visa stamping and is impacted by company layoffs while out of country? Will the visa stamping be impacted? Can the person travel back (assuming stamping goes through)? TC - 300k

Depends on how the layoff happened. If you have access to internal resources and are on payroll with email and slack access then you can come back but if you are on some sort of “garden leave” where you are completely shut out of system but receive paycheck then you can’t. If you do attempt to enter and caught by CBP then technically it’s immigration fraud. Don’t do it. You will get caught and it will be an issue.

Legally you should not travel to US on H1B without a job offer. CBP may not realize that you have been laid off. But you are committing fraud if you enter. Good chance of getting bitten in the future. Legally an employer is supposed to inform USCIS or whoever that they are no longer employing you. If they do, then your visa stamping will be rejected. I learnt a lot from a guy named Mandar ... Wisdom Trends on YouTube. Well ... forced to...because my life is so messed up due to immigration

Most layoff people will be on 60 days Amazon payroll so it’s okay. It’s not fraud. They are still employees.

My company had layoffs while I was out for stamping in India around 10 years ago. My boss called me, learned about my situation, and extended my layoff date until after I entered US so I can search for new roles in US during grace period. The economy was good, so I had offer within a week, but I still remain thankful for their consideration.
