Im not officially remote and my home address is in NY, so my employer has been withholding NYS taxes. However, this past year I have been living in CA. What is the likelihood I get audited by CA/IRS if I just file NYS taxes? Is it a big risk? The difference between CA and NY taxes is not negligible. I have been renting month to month and airbnbs and have 2 cars registered in CA. #cpa #irs #tax
Your employer will report to California if they find out that you're in California. The law in California is that you need to report after just 14 days in the state. CA FTB will absolutely come after you. This is an easy computer audit for them. If your home residence is in NY, NY will argue that you are NY domiciled and therefore a resident. CA will argue that you spend so much time in CA that you're a resident. Get a good SALT attorney or CPA (although those basically don't exist) now.

If you make under $250k I would say the chance is small. I already answered this question for you in another post. I’ve done very similar to you with a car registered in California for several years and nothing happened to me.
I'll flag that the FTB has the ability to audit you indefinitely, even though IRS has a time limit.
I was in a similar situation for a fairly low TC and I got audited by California, I had to prove I was living in NY and paid NYS taxes to get out of it I did actually live in NY but forgot to update some paperwork

The supreme court never decided any such thing. The simply said I'm Comptroller v Wyne that when residents earn money in another state, their state of residence can't double tax them.
The other thing, NY will argue that OP has NY domicile. They will not accept that OP is a non-resident.
