There was a manager who was abusive, and I talked to HR about it. HR told me on video conference that she has told the manager to NEVER EVER do that again. To put it simply, it was when I got affected by Covid-19 lock down last June, and the manager just hope that we treat it as if nothing has happened, and since i joined the company and have the lock down, I have been working 12 hours a day at home. The manager told me I should treat the Covid-19 as if it doesn't exist after he sent me a YouTube "stay well" video, and that I should not be affected by the lock down. To top it off, I didn't know Docker and Kubernetes, and other teams and managers are saying we need at least 2 days to learn them both to do things with it, and it is better if it is 4 days or so. My manager asked me to learn everything in two hours. He also forbid me to talk in the one on one meeting, saying I am not allowed to talk because I am not listening, and then yelling and then hanging up on me. It happened at Cisco Meraki, by the way, where the HR head was cajoling the CEO in every online company meeting. HR talked to him, and told me they have told the manager to never ever do that again. I then asked HR, since they have found that out, why don't they email me for the record. The HR lady, previously claiming that they are fair and they "care" for the employees, said, "NO, I AM NOT GOING TO DO THAT." People said, because HR is protecting the company and the manager. YOU are just a replaceable piece of pawn or minion or a number in the Squid Game. They won't care about you. So, if I have the recording of HR saying they acknowledge the fact that the manager did something wrong, but refuse to put it in writing, isn't it a case for law suit? Essentially they are saying, "We found wrong doing of the manager, but we are not going to acknowledge it for our own legal protection." This behavior itself is already treading into the illegal ground. #legal #cisco #meraki
Dude you need to quit and move on. This is unacceptable and you should make that clear by leaving. What are you looking to get from this post? Advise or just venting?
advice obviously. I want to be able to sue, or telephone God and have them fry in Hell
No, it's not case for a lawsuit. You can't compel another party to put things in writing for you in this case. It is up to you to keep the appropriate notes on what happened. The recording may also be illegal depending on your state's recording consent laws.
so we live in a society where: this is the truth, but we are not going to allow you to use it as a fact in a court, take it or leave this place So it is an emperor place or a slave come here and obey us place?
Don't quote me, but I think there is an exception to anti-wiretapping/electronic-evesdroping laws for if a crime is being committed. I don't know if this constitutes a crime though, but definitely sounds toxic so I'd run far away from this company and people.
Why don't you send an email to HR summarising everything you discussed on call. They can't refute It, if it's true
the tactic they use is simply not reply the email, or reply with some boilerplate text
Thats fine. Atleast you have written proof. If your manager behaves same way again, you can say that HR didn't do anything even though you informed earlier
You recorded them? Umm... that might be illegal. You cannot ask them to do whatever you want them to do. Document everything on your side.
If I were you I would not get into suing. If things get to that point generally they will end up in arbitration because chances are you agreed to an arbitration when you signed your offer letter. Statistically arbitration ends up in favor of an employer 95% of the time. So just move out of the team or find be employer. For your own peace of mind move on. Switch companies. Don't think of legal action you will end up ruining your own peace. Just find another job and quit
What are you hoping to get out of it? If you want fairness, just forget about it. There's no fairness in the corporate world. Just move on.
HR isn’t going to tell you if or how the manager is being punished. They also aren’t going to put their findings in writing and send it to you. That’s just the way HR works. You got the investigation you wanted and you got some info from HR verbally. If that’s not enough then you can either sue the company or quit
it that's the way it is... then I think if we accept it to begin with, we can have a peace of mind. But if I take this notion to begin my job, I will appear cold and apathetic, non-compassionate, and emotionless. But maybe that's why that is what I find of other coworkers in some companies. You know, when companies look for people, they always say they want to find people with a passion, and then they do things that make you become non-compassionate, it is such hypocrite actions.
You come across as someone who expects everything handed to them and you get your tender feelings hurt when someone is stern with you. You’re in the real world and no one cares. Your manager may have been a bully but they didn’t break any laws and probably didn’t break company policies. Your HR person humored your complaint but nothing will come of it. You can either toughen up and learn the new tech stack or you can quit and hope you find a company that will tolerate you. I encourage you to toughen up. Grind through this hardship and see how much stronger you are afterward.
Not a lawyer, but hard to think of a cause of action that will pay you enough to change your life. Also, recording without permission is illegal in half the US. Get a job elsewhere and trash them online
Sad. Hope you get through this. Try changing teams or switching companies than live in such a toxic place.
