Currently an SDE at Amazon. My H1B expires in October 2025 (6 years, yes), and my PERM process that has started over 6 months ago is now stuck in limbo. I am at a subsidiary of Amazon that has its own immigration and they say they would resume PERM in October this year. Still it may be a challenge getting everything right. What other options should I consider? #tech #immigration #perm #i140

You should have been in panic the day you joined AMAZON
Alright NVIDIA, I’m not in the mood right now. I’ve got a bigger problem to solve
Travel. That time gets subtracted from your 6 years and gets added back later to extend your deadline. So travel out of the country and stay out as long as possible. File For h1 extension for all the time you were out of the country during the last 6 years. You will have to plan whether to travel first or file the extension first but this is a good way assuming you can travel and work from elsewhere for a few months. There is also another way to save time once they decide to file. Sometimes they can do 2 steps at once rather than do one at a time, depending on urgency. Another option is to try to find another employer that might agree to file immediately. That being said, market is tough and that may not happen but you can try. Also speak to an immigration attorney. My understanding is if you do miss the deadline, you might have to leave the country for a year. After that the 6 year limit resets and no lottery is needed. Again, only an attorney can confirm all of these.
I think you can come back after it's been 1 year since perm was filed? So not necessarily stay out of country for one year?
> After that the 6 year limit resets and no lottery is needed. Again, only an attorney can confirm all of these. Only if you have PERM, otherwise you gotta go through lottery again
You can move to Canada or India. If Amazon continues to support your PERM, once your I-140 is approved you can get back on H-1B

Turn the situation in your favor: Take on a SDM role, move to another country for a year and comeback on L1, get EB1. Switch back to IC if you like.

No need to panic. Even if you switch employers it will take 2+ years for PERM approval. You need to maintain employment and ensure Amazon supports moving to a different country.

Your h1b will have to be renewed every year, until perm goes through.
Is it possible to renew h1b post 6 years without i-140?
Yes. You can renew. The overhead is that you have file paperwork every year, if you don't have i140
