Received EAD/AP card. Green card PD has been current for a while now. I am getting a lot of offers for product consulting and designing where I’ll be paid for my time (not a direct competitor to current employer). Are there folks on H-1B visa who earn passive income after getting EAD/AP card? What is the process one needs to follow? Do you give out invoices for getting paid? Getting EAD doesn't mean you are on it. You are still on H1, until you change I9 with your current employer. (2) if you change i9 with current employer, or give EAD new employer (even part time or consulting), you are out of h1b and can't enter on it in US anymore.
What do you mean by “Getting EAD doesn’t mean you are on it”. When ppl freelance, they don’t really have an employer to file H1 as it may be a day or a week’s worth of work.
OP, tell your current employer to use EAD/AP as your immigrant ‘status’. Then you can do your side gig.
Does that mean I forfeit my H-1B?
Yes.
