What notice do you give when leaving job?
My fiance got an RFE on her STEM OPT asking for her employment history. Reason for RFE is that she accrued 93 days of unemployment. I know that the rule says only 90 days, but is there a chance they'll consider? The offer was delayed due to background check by a stupid third party company that took a whole lot of 22 days to process. Also, she received her EAD card 4 days after her start day. #workvisa #rfe #opt #uscis
I know that there's a thing in immigration that attorneys do where you can ask to get forgiven by USCIS for a couple of days. I don't know about STEM OPT specifically, but I know that for H1 transfer, it's a thing. If there's a competent immigration firm invovled, it should be ok.
Okay, That sounds great to hear. Will let her know. This is a bit of relief. Thanks
Hire a good immigration attonney. Don't risk it yourself! Should be forgiven
They might do a case-by-case basis. Respond to the RFE and hope for the best. I believe you're allowed to provide justifications as well so make sure to do that in your case packet
Yaa, she has a letter from her current company(a huge MNC) that they had delays due to the BGV. We were just anxious on how to respond.
