However, no mass layoff was done in secrecy this year... until now, that is. Tesla fired 10% of staff and is trying to cover it up. I talked with Tesla software engineers in California who were let go, to understand what happened. Here's the short of it: Tesla terminated ~10% of its workforce and made it look like these are performance-related layoffs. But it was actually a mass layoff happening in one go. I talked with three software engineers who all exited on Wednesday, 14 June. The setup was the same in all cases: - The manager of the employee read from a script when terminating the employment, saying they were terminating based on performance. - These meetings were done in secret, in the sense only the affected employee and their manager knew of the layoff. - Employees had five business days to accept the severance package, which is one week only. Compare this with both Klarna and Coinbase’s offerings of at least 14 weeks-worth of severance. - Managers were not allowed to say the layoffs were en masse; to do so risked their own position. Tesla is trying to bypass the WARN act in California in order to avoid paying severance. This act requires the employer to pay 60 days of salary and benefits if it does not give at least 60 days notice before a mass layoff. Tesla failed to give notice, yet is laying off in bulk. Employees being laid off now are in a difficult situation. Officially, they were let go because of performance issues. In reality, they were let go because Tesla decided to fire 10% of employees. But their reference check will not confirm this. As a result, Tesla employees have taken the sharing of facts into their own hands. Just search for "Tesla 10%" and you'll see what I mean. The software engineers I talked with were in disbelief, but also very worried because Tesla is providing little to no benefit. One week’s severance is paltry; it’s practically nothing. Those I talked with are in touch with employment lawyers to see if they can legally challenge the decision. A lawsuit was filed on Sunday, 19th June, by several former employees, alleging Tesla violated law by not providing advance notice of the layoffs. Employees are referring to the WARN act in this lawsuit. I'm awarding the worst mass layoff award of 2022 to Tesla both for the 1-week severance, and for trying to do mass layoffs under the disguise of performance-related layoffs.
