Hi, I am trying to buy a house in Texas Austin. I am on valid (approved I797 till 2025) H1B Visa with no stamping in the passport. My Mortgage lender is saying that the underwriter requires a stamping in the passport to approve the mortgage. Can I not get a mortgage with valid approved I797 but with no visa stamping in the passport? Is there any official link or website that I can point them to? Please let me know. Find another lender and tell this lender to GTFO. If valid stamping is needed then half of H1Bs might not have bought the house…that’s not a requirement Approved I797 is enough
You need a valid status in US it can be via visa stamp or I797.
You have valid I-94, that's all matters. They don't need to know whether that's through Visa stamp or I-797. I think they are doing this to scare you so you'll overlook other loan terms and fees. Stay away from this lender, find someone else even if you'll have to pay little higher rate.
Look for other lenders they all have different requirements
