Here is a snippet from the signed NDA with my current employer: " You agree that for the term of your employment plus 12 months following termination of employment not to become (whether directly or indirectly) an employee, contractor or fiduciary, of any Employer's client, without first securing the written consent of Employer, which may be given or denied at the sole discretion of Employer. Following termination of employment, this restriction shall only apply to: (i) any clients or prospective clients you had any contact with during the 24 months preceding termination of employment; and separately, (ii) any clients about whom you possess trade secret or confidential information. The restriction applies broadly, without the limitations in (i) and (ii), while you remain employed " Does it mean I can't apply for FTE position at Google? What kind of penalty can one expect by violating this rule? I would like to apply for FTE position here but It seems better to apply for FTE position at another company. Is it true that Google treats vendors as external candidates and even when the company decides to convert them to FTE, you still have to go through phone screen + onsite interviews? It actually makes no sense of being a vendor here in terms of future employment.
It’s at will employment, you can go interview whenever you’re ready. No penalty. Conversion would be easier though, you get less rounds of interviews because they consider your work. Probably similar to intern situation.
göktürk, You are right, it's 'at-will employment'. Both I and my employer can terminate the employment relationship at any time, with or without cause, and with or without notice. It feels like I can do whatever I want but this NDA makes me think twice :(

It's just really unlikely they will sue you over this. If you are employed at will, your NDA might not even hold up
I'd say go get that job at Google. Your employer is unlikely to sue you because of this. And California is extremely pro-employee. Abbott is right - a lot of these restrictions don't hold up in CA.

No, temps and fixed-term contractors are two different things. Fixed-term contractors are still considered employees and have white badges. Temps, vendors, and contractors (specialists) have red badges.

Yes Google treats all TVCs as external. You can still apply and interview. Getting an offer is another story. Lot of time left to worry about it.

You can notify your manager a bit later during the interview process. The recruiter might reach out to your manager regardless.
