For those who don't know, employers must notify the state and therefore "warn" employees 60 or more days before a layoff or closure. That said, some companies try to avoid this rule by keeping a person technically "on the books" for two more months before they are officially laid off. This is what recent legal battles are targetting. #layoff #severance

These are all after the fact, not before. The companies give 2 months severance and keep you on payroll for 60 days after laying you off for this reason.
Yeah, that's the messed up part of how some companies try to avoid WARN. It's illegal, but companies seem to be getting away with it. There's plenty of lawsuits with people who don't sign their severance. I wonder how those cases hold up in court.
Isn't this better for an employee though. They have more leverage getting a new job while still being employed and it helps with their visa situation as well if they are on h1.
