Currently working for intel and in the process of getting offer from tsmc. Status- H1B with I-140 approved. Is there any risk if I start working immediately after H1B transfer petition is filed and does not wait for approval ? specially considering the fact that premium processing is not available now and it will take ~3 months for normal processing to get complete ? I am hearing stories about First time H1B transfers getting RFEs. Thank you in advance! #career #hardware

in my personal opinion, it is a HUGE risk to just work on receipt. Unless necessary, best to avoid it. If the H1 gets rejected for ANY reason, it's game over!

You might be walked out of the door immediately considering that you are going to tsmc (competitor?). So wait until your visa is approved.

Op can always say he or she is leaving for personal reasons to take some time out of work. And then hit them with the bamboozle by updating the LinkedIn immediately after joining said competitor.

Recently left Intel for Qualcomm. I had the same doubts as you. After talking with Fragomen, they said that there is generally very low chance of getting an RFE in such cases. But if you do get one, they respond to it and re-apply asap.
If your intel job is safe then My recommendation is DO NOT risk ...just wait for your h1b approval.
I wouldn’t risk it. More RFE requests will become the normal.

You csn apply for premium for I140. You will get approval in 15 days. But you have to pay premium fees from your pocket
