h1b transfer petition filing delay due to travel

Moving from Amzn to Msft and as is very well known of Msft - they took almost 1.5 months now to get me to the point of transfer petition draft and attorney review complete. However they havent yet filed the transfer petition and have asked me for travel plans in the coming 6 months. I am considering making a trip to India for a week and be back by Dec 7. To what extent will this affect the h1b transfer filing times and will it require a lot of rework to my documentation ? Pls advice - as I am trying to make a decision on my travel plans at the earliest. TC: 190k yoe: 3

You should talk to your immigration attorney and tell them your travel plans. Then ask them if that's ok or if this will delay the process ? Also, what else will they need if you do travel - most likely it will be the new i94, new payslips, etc. But honestly, asking your attorney is the way to go.

Travel plans don’t impact anything as long as visa stamping in passport is valid (to enter US if petition is pending).

I would advise against it. If you leave the country, your i94 record might change, and your most recent entry too. This would result in some changes to the petition, and depending on how slow the immigration team is, a delay. If the petition is ready, you should try to ask them to file it asap. After that, it's best to ask the immigration attorney about leaving the country

Yeah .. I agree with your thoughts on several areas. It is true that the immigration team is super slow as is.

In similar situation, will be back from vacation on Dec 10, told attorney to file after dec 10 as you need to be present in US to file H1 transfer
