instagram account hacked and now used by someome else
my account on instagram was hacked a few years ago and the name is now surfacing on instagram and becoming active - is there anyway to remedy this situation - instagram support ia non existent

Support is readily available but why did you wait a few years to report? Hopefully there is info to over turn an account you gave up years ago but reporting sooner is generally better...
