My company X has terminated my employment because of lack of funds. Now I am on 60 days grace period. I got offer two companies A and B(4 weeks after A) A started my H1B (based on X I-797). I'll be getting it in 2 weeks. B just started H1B transfer (based on X I-797). I would like to join B since it has good offer. Since I am under 60 days grace period so I can't wait for B process to finish as It might cross grace period mark. In this scenario. Since B started transfer on X I-797 but then I joined A. Is it legal to join B. OR B has to re-start the H1B transfer based on A(I-797). My plan is to Join A and when B recieved I-797 approval (Based on company X), quit A and join B (I know A will not be happy with me)
I'm in the same boat. Starting with company A next week and B is currently working non the petition. Not sure if B need i797 from A to file as I still haven't received the physical copy.

60 days grace period is a joke in today’s job market. They should give atleast ‘x’ months where ‘x’ is the number of years you have been in this country and a minimum of 6 months if you have I-140 approved.
Company A has filed H1B and Company B will also file H1B next week. My question is do I need to join A since I get out of grace period because of A?

That felt like an algebra problem. So many variables and numbers! Your plan is spot on. Don't worry about some company not being happy about your choices. Look out for yourself. Both companies can use I-797 of the company from where you got laid off. Hope you don't get an RFE on your transfer petitions. All the best! 👍
