non-profit H1B - can I switch companies?

Hello, I’m a software engineer. I’ve been told that when switching companies a new H1B has to he requested and since I have a “non-profit H1B” which was cap exempt, if I were to switch to a company that is for profit, that the cap would apply to me. I started the interview process with a few companies from small startups to even Google. And when I mentioned that I’m on a non-profit/cap exempt H1B, they aborted the process and said, please come back later, since that type of H1B is to cumbersome and it takes too long to get a non-cap exempt H1B. It seems pretty difficult to switch companies in this case, hence I am trying to get a greencard through my current employer. Does anyone have similar experiences or do you have any advice?

I’m a recruiter and had this issue once when I worked at google. I was advised by our immigration team that we would not be able to transfer the non profit h1b like a traditional h1b and that it would be best to reject the candidate. I unfortunately don’t have any advice though. Best of luck to you.

Just did it this year and trust me when I say this it’s the most stressful thing I have done ever. Most of the recruiters won’t even entertain you once they know you are on Cap Exempt H1. Also it’s totally understandable from the recruiters side since it’s very long and luck dependent process. I was very very lucky that a company was ready to take the risk on me and somehow I got lucky and got the Cap H1. But trust me it’s like finding a needle in a haystack. The timing has to be super right and plus you need a lot of luck on your side as you need to convince the potential manager that you are worth the wait and 💰. My recommendation would be if you are not from India or China is to stick with the current employer and get your GC. Unfortunately if you are from any of those two countries then try to find a manager and talk to him about your situation. Good luck. Feel free to hit me if you have any questions.
