Well, if i read your post right, he didnt SAY anything untrue, he just left OUT something that could have derailed him (not sure how he covered over the gap, tho). So...TECHNICALLY not lying, yes? If your employer explicitly asks “have you worked in any China company” and he said no, that’s a fraud. People are free to choose what to write on their resume as long as it’s real experience, and if the employer has concerns, the employer is responsible to conduct background check or ask for explicit disclosure.

To hide that in resume is not bad. To hide that intentionally to get visa is actually illegal and fraud. There is a visa fraud email if you care about it deeply.
