Unfortunately, companies do this pretty frequently. This is why we need robust privacy laws.

Gray area. A background check is generally a search of public records, and previously it has been limited to a search police records and previous employment records. That said, whatever you post on social media that isn't specifically locked is also a public record. So it is within their purview to look at it.
