Currently outside USA but due to my profile and the critical role/skills there are multiple options on table to relocate USA. I am new to visa business and want a blind opinion which visa option should I opt. i) I can either get employer sponsor like O1 or apply intra-company transfer (L1) and save visa/relocation cost. 2) EB2-NIW as my private attorney thinks there are good chances to get approval given my research profile (PhD, several publications, citations, critical role, media highlights, awards, scholarships, recommendations, job offers, ...) but I have to bear the cost of the whole process upto 5-6k USD. What do you think, should I get employer sponsor or apply for EB2-NIW straight? I am not from India or China. I am not is rush so time is no issue. L1 is more powerful than O-1 from immigration point of view as it has been lobbied historically and is on par with H1B. Main advantages of L1: - Spouse can work - True dual intent like H1B: https://isss.temple.edu/international/h-1b-temporary-employees/immigration-concept-dual-intent Other than flexing, O-1 has not much true advantage. Both. It's faster to get employer visa, so you can relocate first. You can apply niw after you are here for more freedom
Time is not an issue - not in rush. Do you think I have to go through EB2 visa anyway if I am on O1?
Your visa status has no influence over EB petition.
