I’m confused..she’s on opt now and only converts to h1 in October, one thing I didn’t know is can H1b be transferred before it activates? The other is I only hear people give notice after they received transfer receipt, but my friend is already leaving the current company this week and taking a month gap before on-boarding the next. Can someone explain if this is doable? Apparently she didn’t think through before making the move because she was even asking me if it’s okay to travel now....
Her employer has an option of cancelling her H1B, which most likely will happen. She shouldnt have moved until October 1st.
NOT AT ALL. Tell her to make sure to either get the h1b transferred(file amendment) with the new company using the approval from the previous company before October 1 or get it withdrawn. I was in a similar situation(involuntarily) and the best option was to withdraw the visa when there is no premium processing !

Not enough. She has to get the approval with the new employer before October 1. Basically her opt automatically terminates after 30th sept and if there is no employer to sponsor her with approved h1b, she can’t work. She can stay in the country till the decision is made on her h1b. She shouldn’t have left the job before 1st Oct. anyways, pay $200 and do a 1hr consultation with lawyers. I did the same and also discussed with company lawyer and the best option was to withdraw
She’s already on last week with current company, this is so bizarre to me...but I don’t feel too surprised given knowing her...
What’s more worrying is that she hasn’t even sign paper with new company..
That's some bull. May be she is not giving you the whole picture. Or very impulsive without any after thought.
The amendment can be filed only if she has already received ? Here It seems she just jumped before getting a approval
