DS160 H1B Misdemeanor

I have been arrested for misdemeanor from a drunk and drive offense which has been settled three years ago with minimal fines and short period of suspension of license. I am now planning to go for my H1B visa stamping to india and as part of the DS160, I have been asked this question with a box to provide more info. “Have you ever been arrested or convicted for any offense or crime , even though subject of pardon, amnesty or similar action ?” Yes or No Anyone in the same boat? Get immigration attorney’s help. You’ll most definitely get a 221g, and request for medical/physiological assessment in a sealed envelope etc. and additional paperwork. And don’t ever lie in your immigration process, you can invite much severe penalty/ban. Drunk driving is more common than you think and you’ll be fine as long as you do the right paper work here. Oh, and don’t drink and drive again.

Answer truthfully - fill it as a Yes. If that results in a 221g or rejection, then that is on you. You made your choices and need to live with it. Don’t lie, it will be a direct rejection for false claims.
