I’m a graduate in Electrical Engineering and chose software industry many years back. Now new rules formulated by DHS to approve visas only when the candidate is from Software graduation background. This can potentially shatter the approval of those who are from non-it background in graduation. I believe there are many people that falls into this category. What are the chances for those who apply now to H-1B extension? My visa is ending during April/May, will I have a chance to re-apply and get it approved under the new government if the first attempt is a failure? Or what are the stakes for getting it re-approved? Atleast what I understood per the rule published here is - they are now saying that a job that requires bachelors in “any field” doesn’t qualify for speciality occupation. There should be a requirement for a degree in a “specific” area or “equivalent” area. Slightly similar question: What happens in case of a career change? For example a person with BS and MS in EE is on H1B in a hardware engineering role in a semiconductor company and the new role is like product analyst, data analyst, data scientist or swe in some other industry like medical, internet, etc?
Courts have already ruled against it. Greg Siskind tweeted about this. The judge had some pretty harsh words about the logic of requiring a specific degree for a whole set of jobs. Accused the USCIS of working against law. Wait till January to be safe.
There is no "rule" against it yet.
