Hello, I have an offer from Apple, but in a year’s time my H4 EAD will expire and I won’t receive a new one for another 3-6 months. This means I can’t work in the US for this time. I was wondering if Apple will fire me or could they accommodate me working in another country for 6 months or put me on leave or something? Also, would I have to pay back the sign on bonus if they fire me after 11 months and 29 days. #workvisa #h4ead #h4eadprocessingtime #apple

Are you swe ?
Yes
Check if they have visa leave or leave of absence policy ?
Good advice. Is visa leave a common benefit in faangmula? I haven’t heard of it before.
Microsoft has this policy, sending people on Visa leave in such cases.
Premium processing for H4EAD will be available by the time yours expire. Don’t discuss this with Apple for now, just join them and build a rapport with the team and gently ask the manager in 1:1 based on the H4EAD premium status.
I heard about premium processing last year in October and at that time my lawyer didn’t know when it would happen and they weren’t sure if it would be applicable to H4EADs. Where did you get this info?
True that I recently read it in an article
That’s not something Apple has to decide on. Your employment is contingent on valid work auth paperwork. Try applying for h1b in the meantime.
Big companies generally put you on unpaid leave in such scenario and you join back as soon as your EAD arrives. I've seen companies waiting for 3-4 months as well. Source: my spouse waited twice during her EAD renewal for 20 days and 1.5months, where employer was completely fine with it and was normal for them.
Thank you! That’s great to hear
I'd say don't worry about it and you don't have to mention this part now. Once you join, you will be part of H1B lottery next year. If you get an H1B, well and good since your gap of unpaid leaves would be only upto October 1st(assuming you will have H1B filed in COS). In case you don't get through H1B next year then you will have to check with management depending on the EAD situation(if it gets delayed). It should be a completely normal process for them. I would say that don't worry about it but I know it won't help you much as I have seen my wife troubled due to these unforeseen circumstances related to EAD. The untimely delays in EAD put a pause in career and is a morale killer but keep yourself composed that this would end in sometime. My wife got through H1B last year after 3 EAD renewals and she has been cruising through her career ever since then. Good luck to you OP
Hey OP, how did it go? Did Apple let you work on H4 EAD? Also, confused with your post? Were you already apple employee or just planning to join after offer on H4 EAD?
Based on current estimates H4 EAD is going to take 1 year for for approval.
Yes, but I can only apply 6 months before it expires. So I will have 6 months where I can’t work. Will Apple fire me?
That's a question for apple but it seems unlikely. You could work remote temporarily
