My wife lost her job today and I am working to get her on H4 and try to get EAD concurrently. Currently she was on the fifth year of H1B and no I-140 approved. Can somebody please tell me what are the latest times for transfer to H4 and H4 EAD. We had done that in 2016 and back then it took 8 months. Please let me know if there are any tricks or tips that to reduce these timelines. TC: 200k

My wife applied for my H4 and H4-EAD in June 2023 when I lost my job (was on H1 and I-140 approved). I got my H4 approved in November 2023 but also secured a job around same time so went back on H1-B because of approved I-140. In my case, H4 application took almost 5 months to get approved. H4-EAD may take longer than that. I would recommend applying H4 and H4-EAD for your wife as soon as possible, so she can still stay in US after the 60 days grace period. I am not sure how she would go back to H1-B after securing the job, something you will have to check with attorney.
8-9 months now to get ead
I’m making a lot of assumptions here, but let’s assume that you are in your 6th or 7th year of h1B with your i140 approved or near approval. You can bundle your h1b + h4 +h4 ead together and if you make it a premium processing your wife’s h4 ead is likely to get approved in 30 days. That’s the fastest way around. All other ways take around 6+ months.
I have I 140 approved in 2017 originally and again in 2023 with current employer. Based on that my current 797 was issued till August 2026. I’m afraid I cannot bundle my H1B with hers.
