Happened last year and was rejected ultimately because of a formality. What are the chances I'll get audited again? I've heard it's pretty much a sure thing if it's the same employer - is that true? Same company and role.
What's PERM?
This is an official audit trigger released by DOL in a FOIA: If the same company and same employee applies for PERM in same calendar year, it is considered an “audit trigger”. If in a different calendar year, then it’s probable. Was original PERM denied or withdrawn?
Last Perm was in 2018, so this doesn't apply? It was denied initially.
The list of triggers last released by DOL is outdated by years, so you might not be safe. Is Perm filed yet? If so I’d take my chances. Otherwise you should switch companies to avoid this trigger.
I’d say increased likelihood but you do what you can really and pray it all goes well..
Why was your PERM denied? What was the formality they stated?
My role title was not generic enough, apparently.
@op soft engineer ? Also dol is looking at perms filed in april 2018 as per icert. Did you get a response ?
