startup on h1b
i am on h1b and i want to build something while working. is there any way I can do it? please note i cannot move to canada or back to India since my child goes to school here and husband is also working here. just asking is there a work around?
You can transfert to any American company under H1B. But you can’t self employ yourself. You need a boss (or co-founder) that will be hierarchically above you. After that, the start-up will have to provide evidence to the USCIS that they can afford your service, can relocate you to your home country at their expense if need be and, of course, the job being offered to you is a specialty occupation and that you are competent to do it.
Can I register the company outside us legally?
Only American companies are eligible to sponsor for H1B.
Or you can do H4 EAD. You can start as many companies as you want.

U can register the company in India and work from here. As long as its not earning any revenue, u dont have to worry about taxes.
Also, u can be share holder in your own company in US. U cannot draw salary from it, because for that u will require everything that people said above. But if u are not expecting any money in short term, nobody can stop u from developing something. Once u get in there, VCs will help u figure it out if its becoming successful.
